Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MFTV website, desktop application, trial, software licence, and related services.

By downloading, installing, purchasing, or using MFTV, you agree to these Terms. If you do not agree, do not use MFTV.

MFTV is currently under development. Some provisions concerning purchases, licensing, and software features will become applicable when those features are publicly available.

1. About MFTV

MFTV is desktop software designed to help users organise, schedule, and play their own media through a television-style experience.

MFTV provides software tools only. It does not provide, sell, host, or license films, television programmes, music, channels, or other third-party media content.

You are responsible for obtaining all permissions and licences required for the media you use with MFTV.

2. Eligibility

You must be legally capable of entering into a binding agreement to purchase or use MFTV.

If you are not legally capable of entering into an agreement on your own, you may use MFTV only with the permission and supervision of a parent or legal guardian.

You may not use MFTV where doing so would violate applicable law.

3. Free trial

MFTV may offer a free trial lasting 30 days.

The trial is provided so that you can evaluate MFTV before purchasing it. Trial functionality, limitations, and availability may change before the public release.

Unless clearly stated otherwise, the trial:

  • Is limited to one trial per user or device
  • May require an internet connection for activation or validation
  • May stop working when the trial period ends
  • Does not create an entitlement to continued free access
  • May not be restarted by reinstalling the application, changing system settings, or creating duplicate identities

You may not bypass, reset, modify, or interfere with trial restrictions.

4. Purchase and licence model

MFTV is intended to be sold as a one-time purchase.

A purchase gives you a limited, personal, revocable, non-exclusive, non-transferable licence to install and use the purchased version of MFTV, subject to these Terms.

The purchase does not transfer ownership of MFTV, its source code, branding, design, or intellectual property to you.

Unless a purchase page clearly states otherwise, one licence permits use on one active device at a time.

5. Device transfers

You may request to transfer your MFTV licence from one device to another using the transfer process made available within the application.

A transfer may require:

  • Deactivating the previous device
  • Internet access
  • Licence validation
  • A waiting period or security review
  • Contacting MFTV support where automatic transfer is unavailable

You may not use licence transfers to share one licence among multiple people or to operate MFTV simultaneously on multiple devices.

MFTV may limit or review unusually frequent transfers where reasonably necessary to prevent fraud, piracy, or unauthorised licence sharing.

6. Permitted use

Subject to these Terms, you may:

  • Install MFTV on one active authorised device
  • Use MFTV for lawful personal purposes
  • Use MFTV with media that you own or are legally authorised to access
  • Make reasonable local backups of your settings and data
  • Transfer your licence using the authorised process

Any rights not expressly granted to you remain reserved by MFTV.

7. Prohibited conduct

You must not, directly or through another person:

  • Share, sell, rent, sublicense, lease, or redistribute your licence key
  • Allow multiple people or devices to use one licence simultaneously
  • Publish or distribute copies of MFTV
  • Circumvent licence activation, trial limits, device restrictions, or security controls
  • Reverse engineer, decompile, disassemble, decode, or attempt to derive MFTV’s source code
  • Modify, patch, adapt, translate, or create derivative works from MFTV
  • Remove or alter copyright, trademark, attribution, or proprietary notices
  • Use debugging, memory-editing, hooking, injection, or similar tools to interfere with MFTV
  • Use MFTV to violate copyright, privacy, broadcasting, or other applicable laws
  • Use MFTV to distribute malware or harmful material
  • Interfere with MFTV’s website, licensing servers, update systems, or other infrastructure
  • Use automated systems to abuse the trial, waitlist, activation, transfer, or support processes
  • Misrepresent your identity or purchase status
  • Resell access to MFTV without written permission

Restrictions on reverse engineering apply to the maximum extent permitted by applicable law. Nothing in these Terms restricts a right that cannot legally be excluded.

8. Your media and content

You retain ownership of the media, schedules, settings, and other content that you use or create through MFTV.

MFTV does not grant you any rights to third-party media.

You are solely responsible for ensuring that:

  • You lawfully possess or access the media
  • Your use does not infringe copyright or other rights
  • You comply with any applicable licence restrictions
  • You do not use MFTV for unlawful public performance, broadcasting, or redistribution

MFTV is not responsible for determining whether you have the right to use a particular file or piece of content.

9. Backups and local data

MFTV may store settings, schedules, logs, metadata, and other application data locally on your device.

You are responsible for maintaining appropriate backups of:

  • Your media files
  • Schedules
  • Application settings
  • Channel configurations
  • Playlists
  • Custom artwork
  • Other important local data

You should create backups before:

  • Installing an update
  • Reinstalling MFTV
  • Resetting your computer
  • Moving data between devices
  • Changing storage locations
  • Modifying your media library

MFTV is not a backup or archival service.

10. Updates, maintenance, and bug fixes

MFTV intends to maintain the software and make reasonable efforts to investigate and fix reproducible bugs.

Where appropriate, MFTV may release:

  • Bug fixes
  • Security patches
  • Compatibility updates
  • Performance improvements
  • Feature changes
  • New versions

The timing and availability of a fix may depend on factors such as:

  • The severity of the problem
  • Whether the issue can be reproduced
  • Operating-system or hardware limitations
  • Third-party software dependencies
  • Security considerations
  • Development resources

Reporting a bug does not guarantee an immediate fix or a fix within a particular period.

You may be required to install available updates to continue receiving support or to maintain compatibility with licensing and online services.

Unless expressly promised on the purchase page, a one-time purchase does not guarantee every future major version, feature, edition, or separately released product at no additional charge.

11. Software quality and availability

MFTV aims to provide functional, reliable, and well-maintained software.

However, software can contain errors and may be affected by operating-system updates, drivers, codecs, hardware configurations, file corruption, third-party components, network conditions, or other circumstances outside MFTV’s control.

To the extent permitted by law, MFTV does not guarantee that:

  • Every feature will work without interruption or error
  • MFTV will be compatible with every device, file format, codec, or configuration
  • Every reported issue can be fixed
  • Online activation, updates, or support will always be continuously available
  • Future operating-system or hardware changes will not affect compatibility

Nothing in this section removes any warranty or consumer right that cannot legally be excluded.

12. Technical requirements

You are responsible for ensuring that your device meets the published technical requirements for MFTV.

Certain functionality may require:

  • A supported operating system
  • Sufficient storage and memory
  • Compatible media formats or codecs
  • Internet access for trial activation, licence validation, transfers, updates, or support

MFTV may stop supporting outdated operating systems, hardware, codecs, or application versions where continued support is no longer reasonably practical or secure.

13. Payments

Purchases are expected to be processed by Dodo Payments as Merchant of Record.

Dodo Payments may handle:

  • Checkout
  • Payment processing
  • Taxes
  • Invoices
  • Currency conversion
  • Fraud checks
  • Refund processing
  • Payment disputes and chargebacks

Your purchase may also be subject to Dodo Payments’ buyer terms and privacy policy.

Prices, currencies, taxes, and available payment methods will be displayed during checkout.

14. Refunds

MFTV provides a 30-day free trial containing the same core software offered with the paid licence. The trial allows you to test MFTV on your device and decide whether it meets your needs before purchasing.

Because users can fully evaluate the software before purchase, all purchases are generally final. We do not provide refunds because you changed your mind, stopped using MFTV, found another product, or failed to evaluate the software during the trial.

We will first make reasonable efforts to diagnose and fix genuine technical problems.

A refund or other remedy may be considered only where:

  • The payment was duplicated or unauthorised
  • Payment was completed but a valid licence was not delivered
  • A licence purchased legitimately cannot be activated because of a fault in MFTV’s licensing system
  • A substantial defect prevents MFTV from functioning and cannot be repaired within a reasonable period
  • A refund is required by applicable consumer law
  • Dodo Payments or the applicable payment network requires a refund

Before a technical refund is considered, you must provide reasonable information requested by support and allow MFTV a reasonable opportunity to investigate, patch, or otherwise resolve the issue.

Approved refunds are processed through Dodo Payments to the original payment method. A refunded, reversed, or charged-back purchase will result in deactivation of the associated licence.

Nothing in this section limits consumer rights that cannot legally be excluded.

15. Licence validation

MFTV may require online activation and periodic licence validation.

Licence validation may be used to:

  • Confirm that a licence is valid
  • Enforce the one-active-device limit
  • Process device transfers
  • Detect fraudulent or shared licences
  • Determine eligibility for updates or support

You must not block, manipulate, imitate, or interfere with licence validation for the purpose of bypassing these Terms.

Temporary technical problems affecting validation will be addressed where reasonably possible. You should contact support if you believe a valid licence has been incorrectly rejected.

16. Suspension and termination

MFTV may suspend, restrict, or revoke a trial, licence, transfer request, or access to related services where there is reasonable evidence of:

  • Licence sharing or resale
  • Trial abuse
  • Piracy
  • Reverse engineering or unauthorised modification
  • Fraudulent payment
  • Chargeback abuse
  • Interference with licensing or security systems
  • Material violation of these Terms
  • Use that creates security, legal, or operational risk

Where reasonably practical, we may provide notice and an opportunity to resolve the issue.

Immediate action may be taken where necessary to prevent fraud, piracy, security threats, or legal harm.

Termination does not give you the right to continue using MFTV.

17. Intellectual property

MFTV, including its software, source code, executable code, interface, design, graphics, documentation, logos, branding, and original content, is owned by or licensed to MFTV.

These materials are protected by applicable copyright, trademark, and other intellectual-property laws.

“MFTV,” “My Flippin’ TV,” associated logos, and related branding may not be used without prior written permission.

18. Feedback

You may voluntarily send suggestions, ideas, bug reports, or other feedback.

You retain ownership of any original material contained in your feedback. However, you grant MFTV a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, develop, and incorporate the feedback into MFTV without compensation or obligation to you.

Do not submit feedback containing confidential information belonging to another person.

19. Third-party software and services

MFTV may interact with or rely upon third-party components, operating-system features, codecs, services, libraries, or infrastructure.

Third-party products and services may be governed by separate terms and licences.

MFTV is not responsible for third-party services that it does not control, including their availability, changes, security, or compatibility.

Open-source components included with MFTV remain subject to their applicable open-source licences.

20. Disclaimer of warranties

To the maximum extent permitted by applicable law, MFTV is provided on an “as available” basis.

MFTV does not disclaim any warranty, guarantee, remedy, or consumer right that cannot legally be excluded.

Subject to those mandatory rights, MFTV disclaims implied warranties including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

This section does not mean that MFTV intends to distribute knowingly broken software. MFTV intends to test, maintain, and improve the application and make reasonable efforts to patch confirmed defects.

21. Limitation of liability

To the maximum extent permitted by applicable law, MFTV will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from your use of or inability to use MFTV.

This may include loss of:

  • Data
  • Media files
  • Schedules or settings
  • Profits or revenue
  • Business opportunities
  • Reputation
  • Time
  • Expected savings

Where liability cannot be excluded completely, MFTV’s total liability relating to a purchase or use of MFTV will not exceed the amount you paid for the affected MFTV licence.

This limitation does not apply where liability cannot legally be limited, including liability arising from fraud or other matters that applicable law does not permit us to exclude.

22. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, or reasonable costs resulting from:

  • Your unlawful use of MFTV
  • Media or content you use without appropriate rights
  • Your violation of these Terms
  • Your interference with MFTV’s licensing, security, or infrastructure

This section does not make you responsible for losses caused solely by MFTV’s own unlawful conduct.

23. Changes to MFTV

MFTV may modify, add, remove, replace, or discontinue features where reasonably necessary for development, security, compatibility, legal compliance, or product improvement.

We will try to avoid changes that unnecessarily remove the core value of a purchased product.

Where a material change affects purchasers, we may provide notice through the website, application, or email.

24. Changes to these Terms

We may update these Terms as MFTV develops or when legal, technical, or commercial requirements change.

The updated Terms will be published with a revised “Last updated” date.

Where required by law, material changes will apply only after appropriate notice or consent.

Your continued use of MFTV after updated Terms take effect constitutes acceptance where permitted by law.

25. Governing rules

These Terms are governed by applicable law, subject to any mandatory consumer rights available in the country or region where you live.

The governing law and dispute venue may be clarified before MFTV’s public release.

Before beginning formal legal proceedings, you and MFTV should first attempt in good faith to resolve the dispute by contactingsupport@getmftv.com.

Nothing in this section prevents either party from seeking urgent legal relief where necessary.

26. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.

An invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted by law.

27. No waiver

If MFTV does not immediately enforce a provision of these Terms, that does not waive the right to enforce it later.

28. Entire agreement

These Terms, together with the Privacy Policy, checkout terms, and any specific licence or purchase conditions shown to you, form the agreement concerning your use and purchase of MFTV.

If specific purchase terms conflict with these general Terms, the specific purchase terms will apply to that purchase to the extent of the conflict.
